Board of Adjustment to Conduct Public Hearing at March 12, 2025 Meeting

The Town of Duck Board of Adjustment will conduct Public Hearings on March 12, 2025 at 12:00 p.m. to receive comments relating to the following variance applications: 

BOV-2025-001  An application submitted by property owners Paul & Kathleen Mauk for minimum setback variances to replace an existing swimming pool and pool deck in the same, nonconforming locations at 130 S. Snow Geese Drive.

  1. Variance of 4.4 feet to permit a setback of 20.6 feet from the front property line.  Town Code Section 156.030(D)(3) requires a minimum setback of 25 feet from the front property line.
  2. Variance of 6.9 feet to permit a setback of 13.1 feet from the southern side property line. Town Code Section 156.030(D)(4) requires a minimum setback of 20 feet from side street property lines for corner lots. 

BOV-2025-002 An application submitted by project representative Jordan Daneker with Evolve Design Build on behalf of property owners Rick and Kristin Schultz for a minimum setback variance to replace an existing pergola and pool deck in the same, nonconforming locations at 139 Buffell Head Road.  The property is located within the beach nourishment area and improvements are subject to a minimum setback from the Static Vegetation Line (SVL).

  1. Variance of up to 26.9 feet to permit a setback of 3.1 feet from the Static Vegetation Line (SVL) for replacement of the pergola and concrete decking with permeable pavers surrounding the existing swimming pool per the submitted site plan.  Town Code Section 156.124 requires a minimum setback of 30 feet from the SVL.

Box 8369, Duck, North Carolina 27949, or via e-mail at info@ducknc.gov.  Per State Statute, only the name and address of people submitting written comments will be provided to the Board of Adjustment prior to or at the meeting as related to these requests.  Staff reports will be available approximately five days in advance of the meeting at the Town Administrative offices at 1200 Duck Road or via the Town’s website at https://ducknc.gov/board-of-adjustment/
