The North Carolina Constitution (Article IX, Section 7), specifies, that “the clear proceeds of all penalties and forfeitures and of all fines collected in the several counties for any breach of the penal laws of the State, shall belong to and remain in the several counties, and shall be faithfully appropriated and used exclusively for maintaining free public schools.” Click here for more info.
In other words, is Duck a “speed trap”? Answer: No.
The North Carolina Department of Transportation sets speed limits on NC 12 (Duck Road) based on traffic and safety studies. While the Town can request a review of a posted speed limit, it does not choose the speed limit. The Town of Duck receives a $5.00 service fee for each traffic citation, when court costs are assigned by the Court. In terms of officer salary, training, equipment purchases/replacement and maintenance, it costs the Town considerably more in expenditures versus revenue. The Town of Duck Police Department issues traffic citations to make the Town of Duck a safer place to live in and visit.
Yes! The Duck Police Department partnered with Outer Banks Health, Dare County, and other local law enforcement agencies to bring the Blue Envelope Program to our community.
